Spent last couple of hours reading this.....interesting read!

Thanks for the links, they were very interesting but sad. I make a point to not buy fabric or designs of someone who sues or threatens to sue. I just don't like conflict and avoid it if possible.
|
I'm glad you posted this...I had read about it last fall and was glad to find how it turned out.

Read this with interest as I am seeing more patterns that state the items made from the pattern cannot be sold and are for personal use only. It is a shame that this happened, both for the fabric designer and the others involved.
When I see that on a pattern I just put it back. I also read the selvages and when they have lots of what you can't do with the fabric I don't buy it. There are plenty of fabrics and patterns that do not curtail your use of them. mltquilt |
Thanks for sharing this information. will be careful to read selvages closely.

I usually make up patterns for items, or use free ones. I buy my fabric at Walmart most of the time. This is why! If I can going to get in trouble for using a piece of fabric, I won't use it.
I have a Brother Disney machine and the legalese they include makes it seem like I have to deed my machine over to my granddaughter if I make her a shirt with one of their designs. I have never made anything with any of the Disney designs. Phyllis |

but did you know that has existed on all the store bought patterns IE: McCalls, Simplicity, etc since the dawn of time? With the event of ONLINE sales, it just brought the terms to the front light...it was OK if you made a few items to sell at the Church Bazaar, or scout fund raiser, but now people are selling in mass online and that changes things greatly!

I read this with interest for hours. I want to design patterns to sell on my friend's website. Can I do that? Can I photograph an item I made using my patterns but someone else's design? What if I have say an Ohio star block in my pattern? If you ask me, (You did ask, didn't you?) the only people to benefit from this silliness are the attorneys. Others will put the book/pattern back on the shelf or not buy the designer's fabric.

Kate Spain has a rebuttal on her website that I happen to run across on my email newsletter. So there you have it a silly feud. Fabrics are becoming complicated.:(:(

very interesting!!!! thanks

Yes Kate makes lovely fabric's and lovely fabric's are made to be used in quilts. I would think copyright means we cannot print this fabric, we cannot copy the pattern of the fabric on lunchbox's, stationary or other thinks. This pattern that Miss Kate created was not copied but used as fabric is intended to be used. So I find this whole copyright thing sad. No laws were broken and that is why there was no lawsuit. Is it nice to name the designer of the fabric, certainly and yes it is respectful. However, all Miss Kate had to do was maybe ask to be recognized next time or just let it go.

Wow. Fasinating read! And one that highlights why I like THIS site. I have never seen the type of snarkiness (if that is not a word it should be) demonstrated on those blogs here! Thanks to all here for creating a forum where questions can be asked and differences of opinion are met with acceptance!
