Is this legal/allowed?
 
Someone was asking this week about a pattern called Picket Fence and a link was posted to one like this on ebay:

I love it but this seller is apparently cutting out patterns from quilt magazines and selling them individually on ebay. Is that legal.....or even allowed?

If one is allowed to resell the magazine, and you are, then I don't see why not.

​Selling the original is probably okay but she can't copy them and sell the copies.

I don't know for sure, but as long as the copyright information isn't removed (it seems to be intact) and s/he isn't making additional copies of the pattern beyond the number of magazines s/he bought, I would think it's okay. I agree with mike'sgirl that I would assume it's the same as reselling the entire magazine. Of course, if you're planning to do that & want to be sure, the best way to know is to contact an attorney in your state.

As others said, it's fine as long as she doesn't make copies. eBay has cracked down in the past on people selling copies of magazine pages.

Yes as long as it is the original pages and not copies of them.

the verbiage states that they are the actual original pages. seems ok to me.

Can not answer this question....but I googled Coats and Clark/Cheryl Fall and found some really cute free patterns..however not the one mentioned.

I could be wrong but I believe that eBay does not allow individual magazine pages to be sold. As far as I know you can sell the whole magazine but not tear it up and sell the pages separately.


ETA: I do remember there being a big fuss about this, ummmm .... maybe 5 years ago.

If a person wants a pattern bad enough they don't care if it is a copy.

Hmmmm... interesting. Kinda like the people that got busted for cutting coupons out of the Sunday paper & selling them to people online. I think that may have had something to do with the stated face value of the coupon, though. I don't know. Laws sure can get confusing sometimes, can't they?

Yes, it is legal. You are able to resale a quilt pattern you have bought so why would you think it is illegal to cut pages from a magazine and sell them individually? The only thing that must NOT be done is to photocopy any pages.

She is doing something perfectly legal, no problem selling the original pages, just can not copy the pages and sell them. Her ad does state they are the original pages. She apparently is not making multiple copies and selling them.
