I guess I never thought of this before but...

is it legal to name a quilt pattern that I designed the same name as someone else named their quilt if the quilt is totally different and not resemble the other persons quilt by the same name?

sharon b 05-29-2010 05:22 PM

It might get confusing when a person is looking for one pattern and get the other

This is America and we have the right to quilt and design. If you made the quilt, you can call it whatever you want too!!!! (I understand why your asking but isn't it a shame we can't enjoy our hobby without the fear of stepping on someone else's toes!)

Well you name your dog the same as other peoples dogs sometimes. ....so why not? ;-)

marsye, you come up with the funniest photos

Other than quilts that have the name copywrited like "Dear Jane," I don't see why not.

I have seen quilts by the same name, but different patterns and designers.

There are even books out their with the same titles, but different authors.

Songs with the same name, different song writers.

I think it would be hard to patent a name to anything LOL

sewnsewer2 05-29-2010 05:43 PM

I have searched this and cannot find the answer :-(

Thanks amma. I just wanted to name my quilt and raffel it off at my guild.

Actually titles of books, titles of songs, and title of movies cannot be copyrighted. That is why you see them having the same name. Of course many people will not use the same name because if you want to have a movie that is huge on it's own merit, you don't want it to be the same name as something else. But legally it is allowed. Having said that I am not sure how that applies to patterns and quilt names because those are more like company or product names. Generally speaking two companies can have the same or similar names so long as they are not in anywhere near the same business. So I guess if you are going on that you should be fine, however, I agree with someone else that if people were to search for your pattern name in Google the other quilt may come up, which would be confusing. Perhaps you can think of a derivative of the name to use for the pattern to make it more unique?

I did that but there were already quilts named those too. :(

Both, it is this one that I designed.

Quite honestly I wouldn't stress about it, if you like the name and It's not a trademarked name like "Dear Jane" like someone said, use it. I am pretty sure that the people who made the "yellow Brick Road" pattern didn't check if no quilt in the history of time ever was named that, because I am sure there were many many that were. They obviously had nothing to do with what the pattern looks like, but I think you will find it impossible to find a unique name when it comes to quilt names since there are so many named quilts out there. LOL

That purty! Love the colors.

Boston1954 05-30-2010 06:06 AM

You could put "Two" or even "Too" (to be cute). That would make it stand out.

grammyp 05-30-2010 06:07 AM

I am so unoriginal. I name mine for the person I give it to.

sewnsewer2 05-30-2010 07:16 AM

Ok thanks everyone! I will name it 'stars in my garden'. The fabrics are florals and so is the backing.

Rachel, I just have to say I love your avatar. You and DH really look like actors! I love the expressions and in this picture you remind me a bit of Melissa Gilbert. :-D
Have you ever told the story of this picture on a thread?

I am not sure if I have mentioned what the picture is, but I guess here is as good as any!! :) My husband, son, and I do Revolutionary War reenacting, this is a picture from one of our events. Reenacting is a great way to get away from everything modern for a weekend, and we love doing it!! Some of our clothes I buy, but others I make. The red dress I am wearing in the picture I made completely by hand (no machine), it took a long time, but it wasn't really hard to put together. I attached a picture that shows my whole dress below. We have not had the opportunity to be an extra in any movies so I guess we aren't really "actors" but I know some reenactors that have. It would be fun to do I think!! :)

Cheers!
Rachel

This pic isn't with my proper stays so it looks weird, but you can get the idea of the dress! :)
