    This is an old quilt top pattern from the early 1930s. I would love to make this quilt. There is one available on Ebay however the seller advertises holding the patent although it obviously isn't her pattern. I am hesitant to buy from her.

    She may have a copyright on the directions, but if the pattern is public domain she can't have a copyright on that. I don't think patents apply to quilt patterns

    It may well be a McKee pattern, in which case, there is a book with the basic pattern in it you can use. Copyrights are what apply to quilt patterns, as with other written stuff.

    I looked at the pattern on eBay, looks like she rewrote a LeeWards pattern

    Hmmm, that is interesting because she is using the original picture to advertise the pattern.

    I am curious-is this link below the one you are talking about? The 'perky pansy' items currently up for bid on Ebay do not have a quilt pattern. I went through quilt history online and came up with the info for the Perky Pansy quilt. If correct, it used to be Progress Quilt Kit No. 1365 "The Pansy". Then Herrschner's sold it as 'Pansy Design'. It was later sold out of the Leewards 1960/61 catalog as "The Perky Pansy". The winning bid on this pattern was $402.87 back in July. Ouch! But it is more than likely the original as I remember my mother ordering from Leewards and patterns did come in the mail looking like this one. Oh, if only we knew enough to keep stuff back then.

    That is the same pattern however not the seller. I asked the seller about her copyright number and she would not give it to me. A copyright number is a matter of public information. I have not been able to find any copyrights in her name so I am skeptical about her right to have a copyright or if she even owns one.

    I'm confused. You don't have to register copyrights. You have one simply by creating something. As for this particular seller, I have no idea if she's ripping someone off, but I'm not surprised you can't "find" her copyright.

    She has a Copyright supposedly. it is only patents that have a numer
