Absolutely. Any copies of a pattern are a violation of copyright.
I thought it would be all right if the book is out of print.
Even if the book is out of print, the author(s) have the copyright. If the author(s) are dead, then the copyright can be passed down to their heirs until the copyright expires, which I think is 50 years after the death of the original owner of the copyright.
I misspoke earlier about any copies being a violation. If the copies are meant to be used by the person who owns the pattern (as in keeping an original while marking up a copy), I believe that there is not a problem. It is if these copies are given or sold to another person that there is a problem.
