Does this apply if it's out of print? It's no longer being sold. And who's to know anyway as long as you don't try to make a profit from it.
Copyrights are in effect for 70 years past the date of death of the copyright holder unless the heirs extend it. In that case, it's longer. And copyright violation is illegal, whether someone finds out about it or not and whether you make a profit or not.
