Out of print does NOT mean out of copyright--which is 50 years and can be extended. As an author, copyright violations upset me a lot!
However, you DO have to copy embroidery patterns, templates, etc. to transfer them to make the quilt, so that is fair use.

Just as an FYI, the legal case mentioned on the first page of this thread was a suit filed by Thea Jirak against Christina Day (these are the two authors of the book in question) for copyright infringement. So, you'd better believe copyright infringement is important to these authors as well! Also note that if you Google the book title or authors, you now get links directly to this thread.

Even if the book is out of print, the author(s) have the copyright. If the author(s) are dead, then the copyright can be passed down to their heirs until the copyright expires, which I think is 50 years after the death of the original owner of the copyright.

I misspoke earlier about any copies being a violation. If the copies are meant to be used by the person who owns the pattern (as in keeping an original while marking up a copy), I believe that there is not a problem. It is if these copies are given or sold to another person that there is a problem.

There is a group on Yahoo groups called SewItsForSale that allows you to post sewing/embroidery/quilting items that you have for sale or that you are looking to buy. This may be a source for you as well.
