We've had discussions of not mass-producing products that use a particular designers work without permission, or some kind of compensatory agreement, and it seems that's what was done here, with the production of the tote bag. It seems Kate Spain had a legitimate grievance. Perhaps it wasn't handled in the best way, but that may be the fault of her lawyers.
But getting back to the original post, I've found that certain brands of quilt fabrics have an extremely light, silky, and in the case of some Art Gallery fabrics, almost papery feel. I don't think this is a sign of poor quality. I think coarseness and a heavy feel would concern me more.

It was the tote bag (not her pattern or design) showing her fabric on it. When a fabric designer makes horrible threats with lawyers because her retail available fabric image was used without her permission then No thanks she can keep her fabric all to herself.

Imagine if someone stuck a photo of one of Bonnie Hunter's famous mystery quilts on a tote bag. People would look at the bag and say, 'Cool, a Bonnie Hunter tote bag!' Do you imagine there wouldn't be an enormous fuss if that happened? It's the same thing here. The company took a close-up photo of a quilt made with Kate Spain fabrics, and stuck it on a tote that nothing to do with Kate Spain. Her fabrics are extremely recognizable; people would look at the tote bag and think, 'Cool, a Kate Spain tote bag!', but it had nothing to do with Kate Spain. She might have absolutely hated the look of the tote bag, and yet here she is being associated with it because of her fabrics being placed on the front of it. They were definitely in the wrong doing that. I think I would have tried to make them cease and desist as well.

Thanks to all for their thoughts. I have decided to go with a different fabric...nothing to do with all that's been said here. Just found another that I love more and its less expensive. Thanks again

C&T Publishing who published her book that had the picture of the quilt on the front used the picture to make tote bags. It is my understanding that without C&T knowing it KS was also having a tote bag produced. C&T is s respected and ethical company and in my opinion would not knowingly violate agreements and copyrights.
