I'll vote for hawk. It does look like the sharp shinned that I was able to find on Google. Also, owls do not usually hunt in the daytime.

Definitely an owl. We see them around here all the time. They are looking for the mice, rabbits, squirrels or any other little animal to swoop down on and grab for dinner.

It looks like a small owl. Did you know that owls cannot move there eyes? That is why their heads swivel. In your 2nd pic it looks like his
head is swiveled. My 6-yr old GD told me this.
