Questions about software
My sister passed away this year and I inherited most of her sewing and embroidery stuff. I got many disk of embroidery designs ( some which I already had). My question is, can I legally sell the disk I have duplicates for. They are the original disk in the original packaging.

The SewItsForSale group at groups.yahoo.com has a list of embroidery designs that cannot be resold. It's quite complicated, as it depends on the company. If you join the group, you can access the list. Here is just a small excerpt from it indicating some of the items that cannot be resold:
Larger companies rules are following and unless otherwise stated can NOT be resold:*Adorable Designs/John Deer (must be in original packaging and must have not kept a copy for the sellers use)*Amazing Designs/Great Notions 3.0.0 version of Click and Stitch*Amazing Designs Software Edit n' Stitch, Digitize n' Stitch, Personalize n' Stitch all versions*Amazing Designs: Lettering Pro Smart Sizer Size Express Fast Fills*Any Amazing design product that was registered or licensed (this does NOT include stock design collections)</pre>

I just got a used copy of Electric Quilt "The Dear Jane" software and it says on the packaging that the software can be sold, gifted, donated, transferred etc as long as the original purchaser deletes and/or destroys any copies that they have.

I think Prism99 and auntpiggylpn are 'spot on' with their info. Some companies (Disney/Harley Davidson/others) have staff lawyers and will take you to court in a NJ minute--and win their case--costing you $10,000. or more and a jail sentence if you sell duplicates of their designs. Disney does not even allow you to sell items with their designs. They are strictly for personal use. Many digitizers state fully in their copyright warnings that you cannot sell or give away their creations. Tough, but it is their talent and their time that makes the designs and software available to us. I'd certainly do some research before I ended up in a hoosegow!
