Oh my gosh that is stinking cute! I want to run right out there to see if my local TM store has any!
I think you'll be fine using it. Wash it and see how it cleans up. That's a great way to see how well the fabric will hold other than the feel of it... some fabrics are starched so much that after you wash them they're totally different afterwards. That fabric is so adorable though. I'd personally use it - if it felt good to me.

I have purchased other fabric fat quarters from Tuesday Morning and been very pleased with them. I can't afford the prices at the local quilt shops of $12-$18 yd. I go by the feel of the fabric. The local quilt shops have Moda blenders that are extremely thin compared to what they used to be.

I think of this more as a moral and legal issue. To me it's a question of whether I would buy it at all. I would not, and I would let Moda know about these counterfeits. It's not legal for them to just copy another company's fabric designs. If you let Moda know, you might even get rewarded with some of the genuine fabrics.
