Checking that site over, Terry, it seems that only her name and pictures are registered.

Basically, you could the pattern that you posted and even make the ornaments in similar materials and colors. There is no TM infringement there that I can see. Basically, if you're making Christmas ornaments in red, green and white, how can anyone say that is an infringement. Those are traditional colors.

However, if you got the EXACT materials and used them in the same fashion, then she might have something to stand on.

But as the pattern is a "free" pattern, she does not have a copyright on that pattern and you are able to use it?

Is that any clearer?

We used to make these ornaments years and years ago in girl scouts. Won't tell you how old I am, but believe me, it's been a long time. We used fabric or wide ribbon to make them (remember when ribbon was a stiff-like fabric on the bolt and you bought it by the yard). Some were round and some were egg shaped. Used to get that real wide ribbon at Frank's Nursery (may they rest in peace - I sure do miss that store). As a matter of fact, I just found an old bag of that ribbon, in a Frank's bag, in a box of old stuff in my garage and I couldn't remember what it was for. Thanks for the reminder.

That pattern is also very similar to the star hot-pad that my granny used to make. I'll try to post a picture later of the first hot-pad I made with her using that pattern. First I've got to find it. I was so proud of it that I wouldn't let anyone use it, ever. AND I still have it.

I checked out that website and I'm pretty sure that shes just referring to not copying any part of the site itself for personal use. It amazes me that she's getting the $ she is for her oraments. Her ornaments are nice but we all know how much they cost to make. WOW - I've been in the wrong profession all these years. Guess now that I've retired I should think about supplementing my meager income and make ornaments.

burnsk---I'm with you. A little holiday cash is on the way! I had to laugh when you talked about the hot pads----mom wouldn't teach me to sew unless I made a ton of hot pads for her first. Needless to say, it took me a very long time to learn on my own (she does give me lessons when we see each other LOL)...I remember those pads oh so well. As far as franks goes, I'm still living with my ribbon stash from the time they closed. I think I got everything 75% off the sale price. We had a cart full of ribbon and my poor DH just smiled and shook his head....he had to wonder what in the world I'd do with all of it but didn't complain once :lol:

Checked out that address - loved the name of her store "Artsyfartsy". Who ever it is they definitely have a sense of humor. I wonder if they quilt? LOL

I too made these years ago from a pattern I got here in England, I sold quite a few for about $10 about 15 years ago. You will enjoy making them, I have one I kept which has the date on 1990 which I did in x stitch on aida with xmas coloured leaves etc for the centre, it comes out every year to put on my tree.

Here is a picture of 3 of the many I made last year. You'll need a LOT of pins and your fingers will get sore pushing them in. The more you make you'll learn how to really get the look that you like.

I remember making them in that time too - they were in lots of craft books, so I think someone "may" have beat her to any rights. I am sure the copyright she is referring to is covering her name and website.

I've been seeing more and more of these bogus copyright notices on things from the 70s and 80s.
