At first I thought this forum had blocked her blog....but I went to my favorites and found that the author of that blog has shut it down for our use. :lol:
The pattern there was a yo-yo pattern, made into a Christmas tree ornament. Very simple, done for years. I talked to mom today.....she said SHE made them when she was a kid and she's 82!!!!

I was just reading the link from Scissor Queen and found an article from an intellectual property lawyer saying that even if the author of a pattern states that you can't sell the quilts made from it, a court probably wouldn't uphold a case claiming infringement, BUT this has never been tested. It also says that a few sales on a low key level PROBABLY wouldn't be actionable but mass commercialisation WOUlD be. And that's a grey area surely? How would we draw a line between a few sales and mass commercialistion? Note all the 'probablies'! This is a hot topic! It seems that it is super confusing at times. There are sites that let you get the pattern and use it, but if you make the block, you have to "name" it their block name. If I am making a quilt for a family member with blocks called turnips (just a random name :-)) why on earth would I call the quilt turnips? I want to name my quilt something that would be meaningful to the family member.

Changing the design a little makes it yours. The main thing is not to sell that pattern to someone else. You can make items and sell them though.

4. there is nothing unique about any of the items she shows us how to make. crawl any craft fair and you will find all of it.
5. if she sues somebody who copies her instructions and distributes them without her permission she'll win.
6. if she sues somebody who sells the items they make using her instructions she will get laughed out of court. AND have to pay the defendant's legal fees and court costs.

I admire her ingenuity and determination to make the instructions, take pictures, etc....and would NEVER take that stuff and say they're mine. The the end product.....that's a different story.

um, did that page say before that even using HER CONCEPTS AND IDEAS was prohibited?
My understanding is - and someone can correct me if I'm wrong - you can NOT copyright IDEAS.
So now she's saying that if you have an idea to make a quilted pincushion you are stealing her idea????
I wonder if she makes Hawaiin quilts? Wasn't that someone else's idea? (I do know that each quilt is unique and you aren't supposed to copy the actual cutout)
It's a wonderful website, but I have to wonder sometimes - if someone wants that much control over their ideas why do they make a public website that anyone in the WORLD can look at??
